It was from the clamor of these natives, considered &#8220;deviant&#8221; by their ethnic group, that ATINI was constituted. The objective, then, was to offer help to these natives who did not agree with the practice of infanticide, be it an exception or not.<br \/>\nIn this sense, ATINI does not stand as a voice that asks Brazilian law for the punishment or criminalization of indigenous groups that systematically or non-systematically practice infanticide, since it understands that the laws of Brazilian society cannot be applied indiscriminately to ethnic groups which are part of the national territory, but that have autonomy in social organization and have an extremely different view of the world. In accordance with its stated mission, ATINI gives a voice to and welcomes the natives who ask for help to save the children with whom they have some degree of kinship from infanticide.<\/p>\n<p>The lack of public policies aimed at meeting the needs of indigenous peoples, whether in the field of healthcare or in terms of taking in those who do not want to submit to the laws of the majority, as in any society, has led the indigenous &#8220;deviants&#8221; to seek help from non-governmental organizations, such as ATINI. In this sense, ATINI does not pretend to have any kind of expertise on the subject, but is committed to WELCOME IN and GIVE VOICE to the natives who ask for help so that their children are not subjected to infanticide, and FIGHT for the Brazilian State to offer what is needed so that they can, as they should be committed to doing, meet the requests of these Indians.<\/p>\n<p>It is known that in any society, in any culture, there are violations and even in terms of cultural practices accepted by the majority, as is the case of ablation or extirpation of the clitoris of girls between 8 and 12 years of age, in some societies, there are those who do not agree with them and do not wish to submit to what they consider to be something that needs to be changed in their societies. Is there anything wrong with disagreeing with this practice? Is there anything wrong with asking the State to take in these children and their relatives who disagree with this practice? Should the organizations hosting these children and these &#8220;deviant&#8221; individuals be prosecuted and proscribed? Is this not what the Universal Declaration of Human Rights rightly refers to?<\/p>\n<p>These individuals, like any others in the same structural situation of other societies, also have the right not to submit to collective rules which they consider to be a source of suffering and arbitrariness, which in fact exist in every society. Moreover, they have the right to be guaranteed choice, through public policies.<\/p>\n<p>Another example, closer to home, is one involving chauvinism, one of the cultural traits of various societies, including Latin American ones, which has produced very serious acts of violence against women. Although the community does not approve this and there are laws that point to the criminalization of those who practice these acts, it is known that there is a certain complacency and even omission on the part of society, including by many women who submit, for various reasons, to this violence, often classified as &#8220;normal&#8221;. This does not mean, however, that this violence should not be combated by all, especially by the State, not only by laws, but by public policies that protect women and enable them to live a different way of life.<\/p>\n<p>If infanticide is not a cultural practice or a traditional practice, as some argue, if it is just a marginal situation, which is not part of the social rules, those who ask for help when affected by it or by the threat of it need to be assisted, preferably by the State.<\/p>\n<p>ATINI understands that indigenous peoples do not need intrusive or punitive state laws. But this organization does, on the other hand, support any governmental initiative, inside or outside the legislative framework, which guarantees indigenous peoples access to public policies. The criminalization of infanticide is therefore not ATINI\u2019s flag to fly. This organization recognizes and respects the cultural diversity in Brazil. ATINI states that indigenous people need public policies that, among other things, ensure that, whether they &#8220;dissent&#8221; from the majority or not, they have the guaranteed right not to agree, and to change. In fact, all societies are dynamic from a cultural point of view. Em conformidade com sua miss\u00e3o expressa, a ATINI d\u00e1 voz e acolhe os ind\u00edgenas que pedem ajuda para livrar do infantic\u00eddio crian\u00e7as com as quais guardam algum grau de parentesco.\n\nA falta de pol\u00edticas p\u00fablicas voltadas para atender as necessidades dos povos ind\u00edgenas, seja de ordem da sa\u00fade, seja de ordem de acolhimento aos que n\u00e3o querem se submeter \u00e0s leis da maioria, como acontece em qualquer sociedade, tem levado os ind\u00edgenas \u201cdesviantes\u201d a pedir socorro a organiza\u00e7\u00f5es n\u00e3o-governamentais, como \u00e9 o caso da ATINI. Nesse sentido, a ATINI n\u00e3o tem pretens\u00e3o de colocar-se como detentora de qualquer tipo de expertise sobre o assunto, mas tem o compromisso de ACOLHER e DAR VOZ aos ind\u00edgenas que pedem ajuda para que suas crian\u00e7as n\u00e3o sejam submetidas ao infantic\u00eddio e LUTAR para que o Estado Brasileiro ofere\u00e7a condi\u00e7\u00f5es para, como deve ser seu compromisso, atender aos pedidos desses ind\u00edgenas.\n\nSabe-se que, em qualquer sociedade, em qualquer cultura, h\u00e1 viola\u00e7\u00f5es e mesmo em rela\u00e7\u00e3o a pr\u00e1ticas culturais aceitas pela maioria, como \u00e9 o caso da abla\u00e7\u00e3o ou extirpa\u00e7\u00e3o do clit\u00f3ris de meninas entre 8 e 12 anos, em algumas sociedades, h\u00e1 os que n\u00e3o concordam com elas e que n\u00e3o querem se submeter ao que consideram algo que precisa ser mudado em suas sociedades. H\u00e1 algo de errado em discordar dessa pr\u00e1tica? H\u00e1 algo de errado em pedir que o Estado acolha essas crian\u00e7as e seus parentes que n\u00e3o concordam com essa pr\u00e1tica? As organiza\u00e7\u00f5es que acolhem essas crian\u00e7as e esses indiv\u00edduos \u201cdesviantes\u201d devem ser acusadas e proscritas? N\u00e3o \u00e9 sobre isso que, verdadeiramente, versa a Declara\u00e7\u00e3o Universal dos Direitos Humanos?\n\nEsses indiv\u00edduos, como quaisquer outros na mesma situa\u00e7\u00e3o estrutural de outras sociedades, tamb\u00e9m t\u00eam o direito de n\u00e3o se submeterem \u00e0s regras coletivas que consideram fonte de sofrimento e de arbitrariedade, que, ali\u00e1s, existem em toda e qualquer sociedade. E mais, t\u00eam o direito de ter o direito \u00e0 escolha garantido, por meio de pol\u00edticas p\u00fablicas.\n\nUm outro exemplo mais pr\u00f3ximo \u00e9 o que envolve o machismo, um dos tra\u00e7os culturais de v\u00e1rias sociedades, inclusive as latino-americanas, e que tem produzido atos de viol\u00eancia grav\u00edssimos contra as mulheres. Apesar da coletividade n\u00e3o aprovar isso e existirem leis que apontam para a criminaliza\u00e7\u00e3o dos que praticam esses atos, sabe-se que h\u00e1 uma certa complac\u00eancia e mesmo omiss\u00e3o por parte da sociedade, inclusive por parte de muitas mulheres que se submetem, por v\u00e1rios motivos, a essa viol\u00eancia, muitas vezes classificada como \u201cnormal\u201d. Isso n\u00e3o significa, por\u00e9m, que essa viol\u00eancia n\u00e3o deva ser combatida por todos, sobretudo pelo Estado, n\u00e3o apenas por leis, mas por pol\u00edticas p\u00fablicas que protejam as mulheres e possibilitem a elas uma situa\u00e7\u00e3o alternativa de vida.\n\nSe o infantic\u00eddio n\u00e3o \u00e9 uma pr\u00e1tica cultural ou uma pr\u00e1tica tradicional, como defendem alguns, se \u00e9 apenas uma situa\u00e7\u00e3o marginal, que n\u00e3o faz parte das regras sociais, os que pedem ajuda quando acometidos por ele ou pela amea\u00e7a dele precisam ser assistidos, preferencialmente pelo Estado.\n\nA ATINI compreende que os povos ind\u00edgenas n\u00e3o precisam de leis intrusivas ou punitivas do Estado. Mas esta organiza\u00e7\u00e3o ap\u00f3ia, por outro lado, qualquer iniciativa governamental, dentro ou fora do \u00e2mbito legislativo, que garanta aos povos ind\u00edgenas acesso \u00e0s pol\u00edticas p\u00fablicas. A criminaliza\u00e7\u00e3o do infantic\u00eddio n\u00e3o \u00e9, portanto, uma bandeira da ATINI. Esta organiza\u00e7\u00e3o reconhece a diversidade cultural que h\u00e1 no Brasil e a respeita. A ATINI afirma que os povos ind\u00edgenas precisam de pol\u00edticas p\u00fablicas que propiciem, entre outras coisas, que os ind\u00edgenas \u201cdissonantes\u201d da maioria ou n\u00e3o, tenham assegurado seu direito de n\u00e3o concordar, de mudar. Ali\u00e1s, todas as sociedades s\u00e3o din\u00e2micas, do ponto-de-vista cultural.
